Pinly Terms of Service
These Terms set out the rights, obligations, and responsibilities between WAFFLE (the "Company") and users regarding the use of "Pinly" (the "Service"), a family location-sharing service provided by the Company. Matters concerning the collection, use, and provision of location information are also governed by the separate Location-Based Services Terms, and matters concerning the processing of personal information are also governed by the Privacy Policy.

Article 1 (Definitions)
- "Service" means the Pinly app and all related services provided by the Company, regardless of device type.
- "User" means a member who uses the Service in accordance with these Terms.
- "Member" means a person who has provided personal information to the Company and registered an account, and who may use the Service on a continuing basis.
- "Family (group)" means a group formed by members together for the purpose of sharing locations.
- "Pro subscription" means a paid service that gives access to paid features designated by the Company.
Article 2 (Effect and Amendment of the Terms)
- These Terms take effect when they are posted on the Service screen or otherwise notified to users.
- The Company may amend these Terms to the extent that doing so does not violate applicable laws, including the Act on the Regulation of Terms and Conditions and the Act on the Consumer Protection in Electronic Commerce. The Company will give notice of any amendment from 7 days before its effective date (30 days for changes that are unfavorable to users or material).
- If a user continues to use the Service after the effective date of the amended Terms, the user is deemed to have agreed to the amendment.
Article 3 (Formation of the Service Agreement and Use by Minors)
- The service agreement is formed when a user agrees to these Terms, applies for membership (email sign-up or social login), and the Company accepts the application.
- The Company may refuse to accept, or subsequently terminate the service agreement for, any application that falls under any of the following:
- The applicant has used another person's information or provided false information
- A child under 14 has applied without the consent of their legal guardian
- The application violates applicable laws or these Terms
- Users aged 14 or older may create their own account and use the Service.
- Children under 14 may use the Service only with the consent of their legal guardian (parent or guardian). The legal guardian's consent is given through consent confirmation at sign-up, or through invitations and settings in a family (group) formed and managed by the legal guardian. In this case, the legal guardian agrees to these Terms on behalf of the child and is responsible for giving consent and exercising rights regarding the processing of the child's personal information and location information.
- Because the Company does not collect users' age information to provide the Service, the users and their legal guardians are deemed to confirm and warrant that the age and legal guardian consent requirements in paragraphs 2 through 4 are met.
Article 4 (Account Management)
- Members are responsible for managing their account and password and may not transfer or lend them to any third party.
- If a member becomes aware that their account has been stolen or used without authorization by a third party, the member must notify the Company immediately and follow the Company's instructions.
Article 5 (Provision and Change of the Service)
- The Company provides the following services:
- Family location sharing and a real-time map
- Arrival and departure alerts for designated places (geofences) and low-battery alerts
- Emergency (SOS) alerts: a feature that lets a user immediately notify the members of their family (group) of their location and device status. In addition to this feature, and only if the user has granted microphone access on their device, the Company may provide a feature that records ambient sound for a set period (up to 10 seconds) immediately after the alert is sent and delivers it only to the members of the family (group) to which the user belongs. Recorded audio is deleted automatically when the retention period set by the Company has passed; the specific retention period is set out in the Privacy Policy.

- The Company may change all or part of the Service for operational or technical reasons, and will give advance notice of material changes.
Article 6 (Suspension of the Service)
- The Company may temporarily suspend the Service when unavoidable, such as for system maintenance, replacement, or failure, or a communications outage.
- The Company will give advance notice where possible and, in urgent cases, may give notice afterwards.
Article 7 (Plans and Subscriptions)
The Company provides a free service and a paid service (Pro subscription).
- Free: Provides basic features such as family location sharing, place registration (up to 3 places) with arrival and departure alerts, and emergency (SOS) alerts. Ads are shown. The Company does not collect users' age information and, to protect children, shows all users only family-friendly, non-personalized ads in accordance with the Google AdMob Families policy.
- Pro subscription: A subscription product that gives access to paid features. The types and prices of available subscription products are shown on the in-app purchase screen and in each store (Apple App Store, Google Play), and may vary according to store policies, exchange rates, and similar factors.
Payment, renewal, and refunds
- Payment, automatic renewal, receipts, and refunds for the Pro subscription are governed by the policies of the Apple App Store or Google Play.
- Subscriptions are managed through the store account used for payment, and cancellation is done on that store's subscription management screen. The Company's app cannot cancel a subscription directly.
- Unless cancelled, a subscription renews automatically at the end of each period.
- Whether a refund is available, including for unused periods, and the refund procedure follow the policies of the relevant store.
If the Company changes the content or price of a paid service, it will give advance notice, and as a rule the change applies from the renewal after the current paid period ends.
Article 8 (Prohibited Conduct)
Users must not engage in any of the following:
- Collecting, using, or disclosing another person's location information or personal information without their consent (including use for improper purposes such as stalking or surveillance)
- Using another person's account or information, or registering false information
- Interfering with the normal operation of the Service, or accessing it abnormally by automated means
- Infringing the intellectual property rights of the Company or any third party
- Violating laws, public order, or good morals
The Service is intended for safety-oriented location sharing among consenting members such as family, and its use for tracking or monitoring another person's location without their consent is prohibited.
Article 9 (Posts and Content)
- Rights to content registered by a user, such as a profile photo, belong to the user.
- The Company may use such content to the extent necessary to provide and operate the Service.
- The Company may take measures such as suspending or deleting content that violates applicable laws or these Terms.
Article 10 (Intellectual Property)
Intellectual property rights in the Service and its components (software, design, trademarks, logos, etc.) belong to the Company or the rightful owner. Users may not copy, distribute, modify, or commercially use them without the Company's prior consent.
Article 11 (Termination and Restriction of Use)
- Members may terminate the service agreement (delete their account) at any time via Settings > Delete account in the app.
- When a member deletes their account, the Company processes their personal information and location information in accordance with applicable laws and the Privacy Policy.
- If a user violates these Terms or applicable laws, the Company may restrict the user's use of the Service or terminate the service agreement after giving prior notice (or subsequent notice in urgent cases).
Article 12 (Limitation of the Company's Liability)
- The Company is not liable for service failures caused by natural disasters, force majeure, or reasons attributable to the user.
- Location information may differ from actual locations depending on the device environment and network conditions, and the Company does not guarantee the accuracy or completeness of location information. The Service is provided as a supplementary means for safety.
- The Company has no obligation to intervene in disputes arising through the Service between users or between a user and a third party, and is not liable for any resulting damage.
- Unless otherwise specifically provided by applicable laws, the Company is not liable in connection with the use of services provided free of charge.
- The limitations of liability in this Article apply to the extent permitted by applicable laws and do not apply to damage caused by the Company's intentional misconduct or gross negligence.
Article 13 (Damages)
If the Company or a user causes damage to the other party by violating these Terms, the party at fault is liable to compensate for that damage.
Article 14 (Governing Law and Jurisdiction)
- These Terms and any disputes between the Company and users are governed by the laws of the Republic of Korea.
- Lawsuits concerning disputes between the Company and a user arising in connection with the use of the Service shall be filed with the court having jurisdiction under the Civil Procedure Act. If the user is a consumer, the lawsuit may be filed with the court having jurisdiction over the user's domicile or residence in accordance with the jurisdiction provisions of the Civil Procedure Act.
